5. The land plot on which the apartment building is located may be encumbered with the right of limited use by other persons. Ways to reduce the noise level
In addition to protecting the structure of buildings and structures from vibration caused by an operating generator set, of considerable importance when placing a power plant on the roof is the problem of reducing the noise level to regulated limits. As a primary measure for noise reduction, special containers or soundproof enclosures are used, into which the generator set itself is mounted. These solutions make it possible to reduce the noise level by 20-30 dB (A) compared to an open power plant.

In general, the noise standards for a running generator set, designed for placing equipment near places where people are permanently located or working, are as follows: the noise level of a running generator is considered acceptable within the range of 75 dB (A) at a distance of 1 m from the power plant.

Delivery of equipment to the installation site
One of the main challenges faced by rooftop power plants is the delivery of equipment to high altitudes. In particular, heavy-duty cranes impose certain restrictions. So a crane with a lifting capacity of 100 tons with a radius of a boom of 30 m is capable of lifting a load whose weight does not exceed 5 tons. The main problem here is not vertical lifting, but the movement of the weight horizontally, since in this case a large load is transferred to the crane boom. For example, to lift a 1.3 MW power plant, weighing 22 tons, on the roof of the eighth floor and install it at a distance of 14 m from the edge, a crane with a lifting capacity of 250 tons is required.

One of the options for solving the problem of cargo delivery by a crane and (or) insufficient free space on the ground for installing a crane is disassembling the power plant into separate parts (engine, generator, frame, etc.), delivering them separately and final assembly already on site installation. In general, this option, of course, takes more time, but in this case, a crane with a lower lifting capacity will be required, and the total cost of installation work will increase slightly.

The third delivery option is the possibility of using a helicopter. Here it is necessary to take into account a large number of existing restrictions, but if they can be overcome, this option is the most cost-effective and time-efficient.

Approvals required for a rooftop power plant
Considering that placing a diesel generator on the roof often leads to a certain change in the appearance of a building, this installation option must be approved by the relevant services and local authorities.

In one case, the municipal authorities consider it impossible to change the appearance of the building, in the other they only impose restrictions on the color of the container or casing. Therefore, in order to avoid problems in the future, it is advisable to coordinate all these issues with the local authorities in advance. In this case, depending on the terms of the contract, obtaining the appropriate permits "falls on the shoulders" of the owner of the generator or the agency involved in its installation.

Fuel supply issues
In accordance with existing standards, a limited amount of fuel can be permanently (stored) on the roof of a building, which is due not only to the weight of the fuel, but also to fire safety requirements. As a rule, the volume of stored fuel is limited to 450 liters in one tank, however, in any case, it is necessary to obtain the approval of the relevant authorities for the entire fuel system.

The larger fuel tank should be at ground level and positioned in accordance with fire safety requirements. From the main tank, fuel can be pumped into a supply tank located on the roof. In this case, the supply tank must be equipped with a float fuel level regulator to control the operation of the pump. The supply tank must be properly sized to prevent overfilling. Issues of equipment for air ducts and exhaust systems
Rooftop placement of the power plant has one of the advantages of being able to save on ductwork and exhaust fumes. However, there are certain limitations here as well. After checking the case materials, discussing the arguments set out in the complaint, objections to the cassation appeal, the Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation finds that there are grounds provided for in Art. 387 Code of Civil Procedure of the Russian Federation, for the cancellation of the held court decisions in cassation.

In accordance with Art. 387 of the Code of Civil Procedure of the Russian Federation, grounds for canceling or changing court decisions in cassation are significant violations of substantive law or rules of procedural law that influenced the outcome of the case and without which the restoration and protection of violated rights, freedoms and legitimate interests, as well as protection of protected the law of public interest.

In resolving the dispute and deciding whether to satisfy the stated requirements, the court of first instance proceeded from the fact that by virtue of the provisions of paragraph 1 of Art. 246 of the Civil Code of the Russian Federation and Part 2 of Art. 36 ZhK of the Russian Federation, the defendant, prior to installation on the roof of an apartment building No. ... at the address: g. ...- microdistrict, of the antenna-mast structure, was obliged to obtain the consent of the owners of the premises, including the plaintiff. After examining the evidence presented by the parties according to the rules of Art. 67 of the Code of Civil Procedure of the Russian Federation, the court concluded that such consent was not received by the defendant, which is confirmed, among other things, by the minutes of the meeting of owners of premises in an apartment building dated February 11, 2011, which the defendant did not appeal against in accordance with the established procedure.

Also, the court of first instance took into account that the permit for the construction of the disputed object No. 141 of October 17, 2005, approved by the deputy mayor of Nyagan M., had a permitting nature, subject to the consent of the owners of the apartment building, as well as the provision of positive conclusions from the state supervision authorities. However, on July 3, 2003, the Center for Sanitary and Epidemiological Supervision of the city of Nyagan did not give a conclusion on the compliance of the SanPiN with the placement of a satellite receiving-transmitting station in apartment No. ... of house No. sanitary zones of sanitary protection to the kindergarten and maternity ward, located on the border of the territory of the named house, and during the consideration of the case by the defendant, such an agreement was not presented.

Since during the construction of the KSKPT equipment as part of the Yugra-PM satellite receiving and transmitting station and telecommunications equipment, the rights of third parties - owners of premises in an apartment building, including the plaintiff, were not respected, the court concluded that it was necessary to oblige the defendant to demolish the structure.

Canceling the decision of the court of first instance and adopting a new decision to refuse to satisfy the stated requirements, the judicial board for civil cases of the court of the Khanty-Mansiysk Autonomous Okrug - Yugra indicated that both the plaintiff and the defendant have equal rights to own, use and dispose of the roof of the house personally and together with other owners of the premises of this house, the resolution of disputes between co-owners of common property in an apartment building about the use of common property does not fall within the competence of the general meeting, the plaintiff has chosen an inappropriate way to protect his rights. Also, the court of appeal indicated that the court did not apply Art. 247 of the Civil Code of the Russian Federation, which establishes the procedure for resolving disputes between owners of property in shared ownership.

Meanwhile, the Judicial Collegium finds that the appellate ruling of the Judicial Collegium for Civil Cases of the Khanty-Mansiysk Autonomous Okrug - Yugra Court of April 10, 2012 was adopted in violation of the norms of substantive and procedural law and cannot be agreed with it on the following grounds.

In accordance with the provisions of Art. 196 Code of Civil Procedure of the Russian Federation, the court makes a decision on the claims stated by the plaintiff.

By virtue of Art. 304 of the Civil Code of the Russian Federation, the owner can demand the elimination of any violations of his rights, even if these violations were not connected with the deprivation of ownership.

A claim for the elimination of violations of the right not related to deprivation of possession shall be satisfied if the plaintiff proves that he is the owner or a person who owns the property on the grounds provided for by law or contract, and that the actions of the defendant not related to the deprivation of possession are violated his ownership or legal possession. This legal position is set out in the resolution of the Plenum of the Supreme Court of the Russian Federation No. 10, Plenum of the Supreme Arbitration Court of the Russian Federation No. 22 dated April 29, 2010 “On some issues arising in judicial practice when resolving disputes related to the protection of property rights and other property rights ".

Voropaev S.L. is the owner of a dwelling in an apartment building No. ... th microdistrict g. ... and by virtue of Art. 36 ZhK of the Russian Federation, on the basis of common share ownership, belongs to the common property in an apartment building, used by the defendant for his own needs.

Since Voropaev S.L. believed that the construction of an antenna-mast structure on the roof of the house violated his rights as a co-owner of the common property, one cannot agree with the conclusion of the court of appeal that the plaintiff had chosen an inappropriate way to protect his rights.

What method of protecting the rights of S.L. Voropaev, in the opinion of the Judicial Collegium for Civil Cases of the Khanty-Mansiysk Autonomous Okrug - Ugra court, is appropriate, was not indicated in the appealed court decision.

As indicated in paragraph 1 of Art. 247 of the Civil Code of the Russian Federation, the possession and use of property in shared ownership is carried out by agreement of all its participants, and if no agreement is reached, in the manner established by the court.

During the consideration of the case, it was established that during the construction of the antenna-mast structure on the roof of the house of OJSC "Yugratel" no agreement was reached with all the participants in the shared ownership of the common property of the apartment building; this issue had not been previously resolved in court either.

Thus, although the defendant has equal rights with other owners to own, use and dispose of the roof of the house, however, the implementation of this right is due to the need to reach an agreement between all participants in shared ownership. This circumstance was not taken into account by the court of appeal.

One cannot agree with the defendant's argument that, in view of his ownership of a significant share in the common shared property, he could use the common property of an apartment building at his own discretion, since the law established a special procedure for the owners to exercise the right to use the common property of an apartment building, which does not depend on the size of the share belonging to the owner.

In addition, referring to the fact that the court of first instance did not apply the provisions of Art. 247 of the Civil Code of the Russian Federation, the judicial collegium for civil cases of the court of the Khanty-Mansiysk Autonomous Okrug - Yugra, when making a new decision, also did not apply this rule of law.

The defendant in the objections indicates that the antenna-mast structure on the roof of a residential building is not an object of urban planning and does not have its features, and therefore, when resolving the issue of the legality of installing this device, the norms of the town planning code are not applicable. Meanwhile, the named circumstance does not exempt the defendant from the need to comply with the sanitary and epidemiological rules and regulations used in the construction of facilities of this type, contained, in particular, in the sanitary and epidemiological rules and regulations "Hygienic requirements for the placement and operation of transmitting radio technical facilities SanPiN 2.1. 8 / 2.2.4.1383-03, approved by the Chief State Sanitary Doctor of the Russian Federation on June 9, 2003.

The above-mentioned circumstances of the judicial collegium for civil cases of the court of the Khanty-Mansiysk Autonomous Okrug - Ugra were not evaluated when the new decision was made.

Violations of the norms of substantive and procedural law committed by the court of appeal are significant and insurmountable, and therefore can be corrected only by canceling the court order.

Taking into account the foregoing, the Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation considers that the appeal ruling of the Judicial Collegium for Civil Cases of the Khanty-Mansiysk Autonomous Okrug - Yugra Court of April 10, 2012 cannot be recognized as legal, it must be canceled, and the case must be sent to a new consideration in the court of appeal.

Based on the foregoing and guided by Art. 387, 388, 390 of the Civil Procedure Code of the Russian Federation, the Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation determined:

V.'s claims were satisfied by the decision of the court of first instance.

The Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation, on V.'s cassation appeal, canceled the appeal ruling in the case, sending the case for a new appeal hearing on the following grounds.

In resolving the dispute and deciding whether to satisfy the stated requirements, the court of first instance proceeded from the fact that by virtue of the provisions of paragraph 1 of Art. 246 of the Civil Code of the Russian Federation and clause 2 of Art. 36 of the RF LCD, the defendant, before installing the antenna-mast structure on the roof of an apartment building, was obliged to obtain the consent of the owners of the premises, including the plaintiff. The court of first instance also took into account that the permit for the construction of the disputed object, approved by local authorities, had a permissive nature, subject to the consent of the owners of the apartment building, as well as the provision of positive conclusions from the state supervision authorities.
